Welcome to GrandTheftGaming. By accessing our website, game servers, or services, you agree to be bound by these Terms of Service. Please read them carefully before making any purchases.

1. Definitions

In these Terms of Service:

• "We", "Us", "Our" refers to GrandTheftGaming and its operators.
• "You", "Your", "User" refers to you, the person accessing our services.
• "Services" refers to our website, game servers, Discord community, and all related platforms.
• "Digital Items" or "Virtual Items" refers to non-physical products including supporter perks, in-game currency, character slots, and other virtual benefits.
• "Donation" refers to a voluntary monetary contribution in exchange for Digital Items.

2. Acceptance of Terms

By accessing or using GrandTheftGaming services, including our website, Garry's Mod game servers, and Discord community, you agree to comply with and be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, you must not use our services. We reserve the right to modify these terms at any time without prior notice. Changes become effective immediately upon posting. You should review these terms before each purchase. Your continued use of our services after any changes constitutes acceptance of the modified terms.

3. Eligibility

3.1 Age Requirements

You must be at least 13 years of age to use our services.

4. User Accounts

4.1 Steam Authentication

Our services use Steam authentication provided by Valve Corporation. By logging in, you authorise us to access your public Steam profile information including your Steam ID, display name, and avatar.

4.2 Account Security

You are solely responsible for maintaining the security of your Steam account and any linked accounts (such as Discord). You must not share your account credentials or allow others to access our services using your identity.

5. User Conduct

When using our services, you agree not to:

• Harass, abuse, threaten, or discriminate against other users
• Use cheats, exploits, automation software, or any unauthorised third-party tools
• Attempt to gain unauthorised access to our systems, databases, or other users' accounts
• Disrupt the normal operation of our servers or services (including DDoS attacks)
• Impersonate staff members, administrators, or other users
• Engage in any form of hate speech, illegal activity, or content harmful to minors
• Advertise or promote other services, communities, or products without permission
• Exploit bugs, glitches, or vulnerabilities instead of reporting them to staff
• Engage in real-money trading (RMT) of in-game items, currency, or accounts
• Attempt to defraud us or other users

Violation of these rules may result in immediate temporary or permanent suspension from all of our services without prior warning and without refund for any donations made.

6. Donations and Digital Items

6.1 Nature of Donations

Donations to GrandTheftGaming are voluntary contributions to support the operation, maintenance, and development of our services. In appreciation of your support, we provide Digital Items and virtual perks. These are not purchases in the traditional sense - you are donating to support our community and receiving virtual benefits as a thank you.

6.2 Digital Items and Virtual Goods

All supporter perks, in-game currency, virtual items, and other Digital Items:

• Are provided for your personal use within our community - they remain part of our services
• Only work within our services and have no use or value outside of them
• Cannot be transferred to other accounts unless we specifically allow it
• Have no real-world value - they're virtual perks, not assets
• Cannot be cashed out, exchanged for real money, crypto, or physical goods
• May be changed or removed by us if needed (see section 6.3)

6.3 Our Right to Modify Digital Items

We reserve the right to modify, adjust, upgrade, downgrade, replace, or remove any Digital Items at any time and for any reason. This includes but is not limited to:

• Balancing changes to maintain fair gameplay
• Removing features that are being exploited or cause technical issues
• Replacing items with alternatives of similar or different value
• Adjusting quantities, limits, or bonuses
• Discontinuing specific perks or features entirely

Such modifications do not entitle you to refunds, compensation, or chargebacks, as you acknowledge this possibility by completing a donation.

6.4 Payment Processing

All payments are processed by third-party payment providers (such as PayPal). By making a donation, you authorise us and our payment processors to charge your chosen payment method. We do not store your full payment card details. You agree to provide accurate and complete payment information.

7. Refunds, Chargebacks, and Disputes

7.1 Refund Policy

Due to the immediate delivery of Digital Items upon payment, donations are generally non-refundable once processed and items have been delivered to your account.

We may consider refund requests only in the following circumstances:

• Technical malfunction preventing delivery of items (you must report this within 48 hours)
• Accidental duplicate payment (subject to verification and a 5% administration fee)
• Fraudulent transaction (subject to investigation)

To request a refund, contact us via our Discord server with your transaction details.

7.2 Chargebacks and Payment Disputes

If you have an issue with your donation, you must contact us directly first to resolve it. Chargebacks cause significant administrative burden and fees.

If you initiate a chargeback or payment dispute without first attempting to resolve the issue with us:

• Your access to all GrandTheftGaming services may be immediately and permanently suspended
• All Digital Items and in-game progress may be removed from your account
• You may be banned from all of our platforms including game servers and Discord
• We reserve the right to pursue recovery of any losses incurred

7.3 UK Consumer Rights

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have a 14-day cooling-off period for online purchases. However, for digital content:

7.4 EU Consumer Rights (Right of Withdrawal)

If you are located in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason. However, this right of withdrawal does not apply to the supply of digital content which is not supplied on a tangible medium if performance has begun with your prior express consent and your acknowledgment that you thereby lose your right of withdrawal.

By completing a donation on GrandTheftGaming, you expressly consent to immediate performance and acknowledge that you will lose your right of withdrawal once the Digital Items have been delivered to your account.

8. Service Availability and Discontinuation

8.1 No Guarantee of Availability

We do not guarantee uninterrupted, continuous, or error-free access to our services. Our servers and website may be unavailable due to maintenance, technical issues, or circumstances beyond our control.

8.2 Service Discontinuation

We will endeavour to provide reasonable notice of any planned permanent closure, but this cannot be guaranteed in all circumstances.

9. Intellectual Property

GrandTheftGaming and its original content, features, branding, and functionality are owned by us and are protected by applicable intellectual property laws. Garry's Mod is a trademark of Facepunch Studios Ltd.

You retain ownership of any original content you create within our services (such as character names and descriptions) but grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute such content within our services for operational purposes.

10. Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your access to any or all of our services at any time, with or without notice, for conduct that we believe:

• Violates these Terms of Service or our server rules
• Is harmful, threatening, or abusive to other users or our staff
• Is harmful to our services, systems, or reputation
• Constitutes fraud, cheating, or exploitation
• Involves chargebacks or payment disputes

Terminated or banned accounts will not receive refunds for any donations made. Appeals may be submitted via our Discord server at our discretion.

11. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• Our services will be uninterrupted, timely, secure, or error-free
• Any defects or errors will be corrected
• Our services will meet your specific requirements or expectations
• Any data or content will be preserved indefinitely

12. Limitation of Liability

To the fullest extent permitted by applicable law, GrandTheftGaming and its operators, staff, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Loss of virtual items, in-game progress, or Digital Items
• Interruption of service or inability to access services
• Any other intangible losses

Our total liability for any claim arising from your use of our services shall not exceed the amount you have paid to us in donations in the 12 months preceding the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

13. Indemnification

You agree to indemnify, defend, and hold harmless GrandTheftGaming and its operators, staff, and volunteers from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your use of our services
• Your violation of these Terms of Service
• Your violation of any rights of another party
• Any content you submit or transmit through our services

14. Third-Party Services

Our services integrate with third-party platforms including but not limited to Steam (Valve Corporation), Discord, and PayPal. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, content, or practices of third-party services.

15. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from or relating to these terms or your use of our services shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means you may also bring proceedings in the courts of your country of residence if you are a consumer.

16. Severability

If any provision of these Terms of Service is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. No Waiver

Our failure to enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. Any waiver of any provision shall only be effective if in writing and signed by us.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and GrandTheftGaming regarding your use of our services and supersede any prior agreements.
